1. Acceptance of Terms
By creating an account, placing an order, or utilizing any hosting services provided by API Hosting ("Company", "we", "us", or "our"), you ("Client", "Customer", or "User") agree to be legally bound by these Terms of Service.
If you are entering into this agreement on behalf of a business entity or community, you represent and warrant that you possess full legal authority to bind such entity. If you do not agree with any part of these terms, you must not access or use our services.
2. Service Description
API Hosting provides high-performance game server hosting, Virtual Private Servers (VPS), dedicated physical servers, and cloud infrastructure management tools.
- Game Server Hosting: Managed instance hosting pre-configured for dedicated multiplayer titles including Minecraft, Rust, ARK, Palworld, and Valheim.
- Virtual Private Servers (VPS): Virtualized Linux and Windows instances with dedicated KVM CPU cores, NVMe storage, and root access.
- Dedicated Hardware: Bare-metal enterprise servers custom-provisioned in tier-3 and tier-4 datacenters globally.
We reserve the right to perform routine system maintenance, apply hardware or software updates, or migrate instances between nodes to ensure maximum performance and security.
3. Acceptable Use Policy
You agree to use our infrastructure strictly for lawful purposes. You are solely responsible for all content, scripts, and software executed on your hosted instances.
- Initiating or participating in Denial of Service (DDoS) attacks, booter/stresser services, or botnets.
- Hosting malware, spyware, ransomware, phishing portals, or illegal pirated media.
- Cryptocurrency mining (e.g., Bitcoin, Monero) or unauthorized distributed compute tasks.
- Executing malicious port scanning, credential stuffing, or network intrusion tools.
- Sending unsolicited bulk commercial emails (SPAM) or operating open mail relays.
4. Payment & Billing
Services are provided on a pre-paid recurring subscription basis (monthly, quarterly, semi-annually, or annually).
- Invoices are generated 7 days prior to the billing renewal date and must be paid in full to prevent service disruption.
- Unpaid game server instances will be suspended 3 days after the due date and permanently terminated with data wipe after 14 days of non-payment.
- All prices listed are exclusive of applicable local taxes unless explicitly stated otherwise.
5. Refund Policy
7-Day Money-Back Guarantee for First-Time Customers
If you are unsatisfied with your game server or VPS hosting within the first 7 days of initial registration, you may request a 100% full refund via support ticket.
Exclusions: Custom dedicated physical hardware, domain name registrations, SSL certificates, and orders canceled due to Acceptable Use Policy violations are strictly non-refundable.
6. Account Responsibilities
You are responsible for maintaining the confidentiality of your account password, API keys, and multi-factor authentication devices.
You are fully responsible for maintaining your own offsite data backups. While API Hosting performs automated system backups, we do not guarantee data availability in the event of hardware corruption, misconfigurations caused by user mods, or accidental file deletion.
7. Service Level Agreement (SLA)
We guarantee a 99.99% network and node power availability SLA across all hosting clusters during any calendar month.
Scheduled maintenance announced 24 hours in advance, third-party ISP routing issues, or client software crashes are excluded from SLA credits.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall API Hosting, its officers, employees, suppliers, or partners be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, revenues, or profit) arising out of or related to your use of or inability to use the services.
In all cases, our total aggregate liability shall not exceed the amount paid by you to API Hosting in the 1 (one) month immediately preceding the incident.
9. Changes to Terms
We reserve the right to revise or update these Terms of Service at any time. Notice of material updates will be sent to your account email address or posted via billing client portal announcements at least 14 days prior to becoming effective.
Continued use of our services following the effective date of updated terms constitutes your acceptance of the revised terms.
